Article 1 – Scope

These terms apply to all offers, services, deliveries, and invoices between AK Group BV (“AK Group”) and the client. Deviations are only valid with prior written approval from AK Group. The client’s general terms are not applicable.

Article 2 – Offers and Validity

Offers are non-binding and valid for 30 calendar days. After that, prices and terms may change. A contract is only concluded upon written confirmation or commencement of the work by AK Group.

Article 3 – Prices and Additional Work

All prices are exclusive of VAT unless stated otherwise. Unforeseen or additional work will be invoiced separately based on current rates.

Article 4 – Payment

• 40% advance payment before work begins.

• Balance upon (partial) completion.
  Invoices must be paid within 14 calendar days of the invoice date.

Article 5 – Late Payment

In case of late payment:

• 1.25% interest per month

• 15% penalty, minimum €250
  Disputes must be sent by registered mail within 8 days. AK Group may suspend work in case of non-payment.

Article 6 – Retention of Title

All materials, plans, and installations remain the property of AK Group until full payment is received.

Article 7 – Execution

Work is performed according to professional standards. Deadlines are indicative. AK Group may adjust schedules in case of force majeure. Visible defects must be reported within 8 days after completion.

Article 8 – Liability

AK Group is only liable for direct, proven damages due to gross negligence or intent. Indirect or consequential damages are excluded. Liability is in any case limited to the invoice amount.

Article 9 – Cancellation

If the client cancels, a fixed compensation of 20% of the offer amount is due.

Article 10 – Privacy

Personal data is processed in accordance with GDPR and the privacy policy available at www.akgroup.be. Data is retained for a maximum of 10 years.

Article 11 – Jurisdiction

Belgian law applies. Disputes fall under the exclusive jurisdiction of the Justice of the Peace or courts of Leuven.
